Understanding CAN-SPAM Act: 7 Rules to Follow for Email Marketing

What is the CAN-SPAM Act?

The CAN-SPAM Act was enacted into law in 2003 in order to provide a framework for email marketers to abide by. Failure to follow the guidelines set forth in the act can result in stiff penalties and fines. You can read the full guidelines at the link above, but they are paraphrased below. There are (7) rules you must follow in regards to email marketing:

1) Don't use false or misleading header information
2) Don't use deceptive subject lines
3) Identify the message as an ad
4) Tell recipients where you're located
5) Tell recipients how to opt out of receiving future emails from you (make it easy to unsubscribe)
6) Honor opt-out requests promptly
7) Monitor what others are doing on your behalf

Please note that as of 4/24/2024 there is no national "Do Not Email List". As long as you follow these guidelines, you are free to send unsolicited email to anyone you wish, provided they have not previously opted-out from receiving emails from you.
